“BACARDí REVIVE LIVE” PROMOTION
 
TERMS AND CONDITIONS

  1. Information on how to enter and the prize(s) form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

  2. Entry is only open to Australian residents aged 18 years or over.

  3. Employees (and their immediate families) of the Promoter, and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.

  4. Entries into the promotion open on 07/12/20 and close at 11:59pm AEDT on 04/02/21 (“Promotional Period”).

    1. Due to reasons beyond our control, select promotional stock was released before the start of the Promotional Period, however, Qualifying Purchases made from 16/11/20 will be honoured for entry into the Promotion once the Promotional Period starts.

  5. To be eligible to enter, individuals must purchase any of the following specially marked products from any off-premise alcohol retailer nationwide (including online) during the Promotional Period (“Qualifying Purchase”):

    1. (i)  Bacardi Carta Blanca White Rum 1L;

    2. (ii)  Bacardi Carta Blanca White Rum 700mL;

    3. (iii)  Bacardi Carta Oro Gold Rum 700mL;

    4. (iv)  Bacardi Spiced Rum 700mL; or

    5. (v)  Bacardi Oakheart Spiced Rum 700mL.

    (each, a “Qualifying Product”).

    For clarity, if multiple Qualifying Products are purchased in a single Qualifying Purchase, the entrant is entitled to one (1) entry for each Qualifying Product purchased, subject to clause 8 below.

  6. To enter the next Daily Prize Draw, individuals must then complete the following steps:

    (i) Scan the QR code located on the Qualifying Product or visit www.bacardirevivelive.com.au and follow the prompts to the promotion entry page;

    1. (ii)  Input the requested details including full name, email address, date of birth, postcode, phone number and specify the Qualifying Product(s) purchased;

    2. (iii)  Upload the receipt from the Qualifying Purchase; and

    3. (iv)  Submit the fully completed entry form during the Promotional Period.

  7. For an entrant to also be entered into the Major Prize Contest, the entrant must, in addition to completing the steps in clause 6 (above), provide an answer, in 3 words, to the question, “What does live music mean to you?”, and submit the fully completed entry form during the Promotional Period.

  8. Multiple entries permitted, subject to the following: (a) a maximum of three (3) entries permitted per Qualifying Purchase; and (b) each entry must be submitted separately and in accordance with entry requirements.

  1. Entrants must retain a copy of their purchase receipt(s) for all entries as proof of purchase. Failure to produce the proof of purchase for all entries when requested may, in the absolute discretion of the Promoter, result in invalidation of ALL of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt(s) must clearly specify the store of purchase and that the purchase was made during the Promotional Period but prior to entry.

  2. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

  3. Incomplete or indecipherable entries will be deemed invalid.

  4. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.

  5. There will be one (1) draw conducted for the entries received each day of the Promotional Period, for a total of sixty (60) draws (“Daily Prize Draws”). There will also be one (1) round of judging for all entries received during the Promotional Period which contain an answer to the promotional question in clause 7 (“Major Prize Contest”). Entries into each Daily Prize Draw will open at 12am and close at 11.59pm each day based on Sydney local time. Non-winning entries in each Daily Prize Draw will be entered into any subsequent Daily Prize Draw(s).

  6. All Daily Prize Draws and judging for the Major Prize Contest will take place at Roilti PTY LTD, 51A / 23 Norton street, Leichhardt, NSW 2040. Each Daily Prize Draw will take place at 12pm (noon) AEDT on the day after entries close for that Daily Prize Draw, with the first Daily Prize Draw taking place on 08/12/20 and the last Daily Prize Draw taking place on 05/02/21. The judging for the Major Prize Contest will take place at 12pm (noon) AEDT on 09/02/21.

  7. The Promoter may draw additional reserve entries (for Daily Prize Draws) or may select additional reserve entries which they determine to be the next best (for the Major Prize Contest), and record them in order in case an invalid entry or ineligible entrant is drawn or selected.

  8. Daily Prize Draw winners will be notified by email within 24 hours of the draw. The Major Prize Contest winner will be notified by phone and email within three (3) business days of the draw.

  9. All winners will be published on www.bacardirevivelive.com.au/winners on 17/02/21.

  10. The Promoter’s decision is final and no correspondence will be entered into.

  11. The Major Prize Contest is a game of skill and chance plays no part in determining the winner. Each entry into the Major Prize Contest will be individually judged based on literary and creative merit of the response provided to the promotional statement.

 
  1. The first valid entry drawn in each Daily Prize Draw will win a JB Hi-Fi e-voucher valued at $250.00.

  2. Any ancillary costs associated with redeeming the JB Hi-Fi e-voucher are not included. Any unused balance of the JB Hi-Fi e-voucher will not be awarded as cash. Redemption of the JB Hi-Fi e-voucher is subject to the terms and conditions of the issuer including those specified on the JB Hi-Fi e-voucher – see https://www.jbhifi.com.au/pages/gift-card-terms-conditions for further details.

  3. The best valid entry submitted for the Major Prize Contest, as determined by the judges, will win a Revive Live Festival Experience for twenty-one (21) adults on a date to be confirmed to the winner in late February/early March 2021, valued at $5,000.00. Prize includes:

    • Tickets for the winner and twenty (20) adults to a music festival at a secret location in NSW;

    • Transport by party bus from a pre-determined location in Sydney city, mutually agreed upon by the Promoter and the winner, to the festival; and

    • Food and alcoholic beverage catering during the festival.

      Flights to Sydney from the winner’s residence, accommodation, spending money, additional meals, insurance, transport to and from party bus departure point, additional transfers, items of a personal nature and all other ancillary costs are not included.

  4. Prize must be taken to coincide with the Revive Live event on the date to be confirmed to the winner.

  5. Itinerary to be determined by the Promoter in its absolute discretion.

  6. Prize is subject to the standard terms and conditions of individual prize and service providers.

  7. If for any reason the winner does not take the prize (or an element of the prize) at the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited and will not be redeemable for cash.

  8. In the event of war, terrorism, state of emergency, pandemic or any other kind of disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.

  9. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy. The Promoter advocates the responsible service and consumption of alcohol.

  10. The Promoter encourages consumers to enjoy responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au. Entry and continued participation in this promotion is subject to the licensee’s liquor serving policy.

  11. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) at/by the time stipulated by the Promoter, then the prize (or that element of the prize) will be forfeited.

 
  1. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

  2. The Revive Live ticket prizes are subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject the winner (and/or their companion/s) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

  3. Total prize pool value is AU$20,000.00. Total game of chance prize pool is $15,000.00.

  4. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.

  5. A draw for any unclaimed Daily Prizes may take place on 05/05/21 at the same time and place as the Daily Prize Draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by email within two (2) business days of the draw and their names will be published on www.bacardirevivelive.com.au/winners on 10/05/21.

  6. If the Revive Live prize remains unclaimed by 4:00pm AEDT on 09/02/21 the prize will be forfeited and the prize will be awarded to the next best valid entry, as determined by the judges. If the unclaimed prize winner cannot be contacted within 24 hours, the Promoter will contact the next best entry until a prize winner is determined. Results will be published on www.bacardirevivelive.com.au/winners from 25/02/21.

  7. Entrants agree that they are fully responsible for any materials they submit via the promotion including but not limited to comments, recordings and images (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove or decline to publish any Content without notice for any reason whatsoever. Entrants warrant and agree that:

    1. (a)  they will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;

    2. (b)  their Content shall not contain viruses or cause injury or harm to any person or entity;

    3. (c)  they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;

    4. (d)  the Content is the original literary work of the entrant that does not infringe the rights of any third party;

    5. (e)  they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and

    6. (f)  they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

 

Without limiting any other terms herein, the entrant agrees to indemnify the Promoter for any breach of the above terms.

  1. As a condition of entering this promotion, each entrant licenses and grants the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their entry (which shall include Content) for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.

  2. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

  3. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

  4. Any cost associated with accessing the promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

  5. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.

  6. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutoryconsumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  7. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the appearance of any or all of the performers are or the Revive Live event is delayed, postponed or cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or entrant; or (g) use of a prize / attendance at the prize event.

 
  1. As a condition of accepting the prize, the winner of the Major Prize (and their companion/s) must sign any legal documentation as and in the form required by the Promoter and/or prize suppliers in their absolute discretion, including but not limited to a legal release and indemnity form.

  2. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.bacardilimited.com/privacy-policy/. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose PI to entities outside of Australia (for a list of the countries, see the Promoter’s Privacy Policy), and cannot guarantee that any overseas recipient will not breach the Australian Privacy Principles. By entering the promotion entrants consent to the overseas transfer on these terms as permitted by the Australian Privacy Principles and agree that the Promoter is not liable in this regard.
